posting of links or re-publication of images taken from a site, even if
those images don't have embedded copyright warnings?

Republication is EXTREMELY different from posting links, and would indeed be
illegal.

Please see my post at <URL:http://www.lugnet.com/dear-lego/?n=877>

I recognize that posting links, rather than actual images, is different, but
I don't think the overarching answer is "if I can get at it, it's fair game."

No one is saying anything about "overarching" or "fair game". There is no
overarching connection between republishing and linking to, because those
things aren't related. And no one is saying that by publishing things on
their web server, the Lego Company loses any of their intellectual property
rights. Those images are still covered by copyright. But by publishing them
(a.k.a. "making them so the public can get at it"), they are certainly
granting implicit permission to view the images. In fact, they grant EXPLICIT
permission on their legal page:

1. You should assume that everything you see or read on this
Site is protected by copyright unless otherwise stated and
may only be used according to these Terms and Condtions.
