It's not entirely a custody matter. In my view Elian applied for asylum
merely by appearing here. The niceties of when was the formal petition filed
and so forth are just legal machinations being used to deny civil rights. His
mother gave her life to make that petition for asylum happen. An asylum
petition takes precendence over a custody decision, in my book.
That asylum petition should be granted, and would be if we lived in a country
that respected the rule of law (but then, remember, I support unrestricted free
immigration of all who wish to come here as long as they are willing to
work)... After it is in force, if Elian's father wishes to pursue custody of
his son HERE because he's decided to move here, that's fine, but once he gains
it, if he does, he cannot return to Cuba with Elian, who has asylum here,
inasmuch as returning him there would directly contravene the very asylum he
seeks.
However, that's not the only way to disprove. Here's another...

Quoting again:

That's direct and demonstrable jeopardy. Therefore I would deny custody. QED.
