Well, Diamond has already released a portable mp3 player that contains
no moving parts. Kinda like a Walkman. Stores mp3's in RAM. I know
of a couple of efforts to produce an mp3 cd player.

IMO there are no gray areas for personal use. If I buy a CD I should
be able to listen to the music on it anywhere, in any format.
