What about Lego trains for instance.  If the Guild models a train that

I think technically yes. For the most part, building, automobile, train,
airplane, and ship manufacturers (things which are regularly modeled)
are all pretty open to scale models. These scale models don't cut into
their business at all, and if anything, promote the brand. Railroad
companies are also pretty open to their markings being used on models.

It varies. For example NS is quite open, approving use of their logo and
color scheme as well as "tribute" logos like the NCLTC uses, for use by
clubs, and UP isn't nearly as open as NS is, not nearly at all, they shunt
you to their marketing agency who doesn't return messages.

I'm not so sure about retail and fast food outlets. I think they are a
little more tight with their names and logos.

I speak from experience when I say I KNOW they are much tighter. I have a
formal license agreement with Skyline Chili to use their trade dress in
MTW-4001 and it is a limited term, limited production volume agreement.
