Nobody fights with bi-planes anymore, but fighter jets are pretty much fighter jets - regardless of era. Same thing goes with tanks or battleships.

The way I’ve heard it is that they don’t produce any weapons developed in the 20th century or later, and that the only reason why we have the Sopwith/Red Baron pair is because LEGO Direct operates under slightly different rules when developing sets that are intended to be S@H exclusives. This WWI vs. WWII theory might explain why they were able to get permission to go ahead with them, but I think it’ll prove to be a bit more complicated than tech-level alone. Even if our technology advances beyond the jet airplane as a staple fighter platform, I doubt we’ll see WWII-era military vehicles produced as LEGO sets if it involves putting a swastika on the box.
