It's not supposed to be so hot that it weakens or melts the styrofoam. it's
not supposed to be so hot that you can get burned by the vapors. McD coffee
WAS too hot and they did have negligence.

Just for my info, can you clarify whether Stella was holding the cup
between her thighs (driving a car, perhaps) at the time of the spill?  It
had been my impression that this was the case, and if so, then tough for
Stella; McDonald's makes no claims about it's cups' thigh-proofness.  If she
was simply holding it and the cup ruptured, then that's a different matter.

The ATLA site (reachable from the link to the myth debunk site that James B.
provided) has a lot of info on this. She wasn't driving. That's a persistent
false myth. Further, it wasn't that the cup ruptured, it was that the coffee
is too hot. Dangerously so, and McD knew it, decided not to change it, and
had settled lots of cases before.

I don't usually have a lot of sympathy for trial lawyers but they're, in my
view, right about this one.

I see this one as similar to the Pinto gastank cases... a big company made a
business decision that they could take the heat(1) rather than change the
product. It was a bad decision. They deserved to be spanked. That's the way
it's supposed to work.
