As an icon, not as a logo, it is fine. As a logo, they strongly prefer that a
3D brick image is not used. I had issues to resolve with TLC's lawyers before
Kidvention regarding LDraw.org's logo -- that is why it has been switched to a
fade-to-wireframe (and the new logo is cooler, too! :)

As a logo it is right out. They may not come after you, but something may come
up in the future where it is addressed. That's what happened to me - no one
approached me through the year of running the site, but when I was talking to
Brad and Robin (the attorney) about Kidvention plans, it was addressed through a
question I asked and caught me off guard. The timing was pretty bad, but
luckily a few people stepped up to the plate to help with a new logo design. I
wish that they had been a little more proactive from the get go on telling me
that was a potential infringement, but it all worked out in the end.
TLC's lawyers don't always act on stuff like that - from what I've heard they
prioritize how prominent a site is or what its content is and determine if its
potentially harmful or not. Then they'll act. Or, I know at one time they were
going to send letters out to over a hundred sites they had collected at once,
with 'lego' in the domain.

Go ahead and use it. Note - Todd has been using the 2x2 as a background and
distributing it for the past 4+ years. AFAIK, no one has come after him or the
other sites which display his background. :o)
