Sounds like you're going to be taking some legal risks no matter what you do, since LEGO has form patents on the minifig itself (as well as most of the weapons), if you have anything that "looks like" a minifig in the game, you're stepping on (...) I think it comes down to how you use the trademark. Using it in the name of the game will not fly (because people could assume the game was a product of TLC). Mentioning in the game rules that TLC makes an excellent set of LEGO sets that can be used (...) (23 years ago, 9-May-03, to lugnet.gaming)
