So technically it was illegal for whoever it was that put DoTF up on the
web to do that??

It depends on who put it up.  You can download it from www.starwars.com,= • the
holders of the copyright, and they can distribute it however they want.
However, if someone else made it available -->without permission <-- or= • not
within "fair use", then yes, it was illegal.  I'm not sure about the fuzzy=

legality of mirror sites for download purposes, though.

Just went back to see who it was, and it was Tom McDonald, who was also
the first one to comment on what I was willing to do was illegal. Now, Tom,=

I want to know why you would point out to someone else that what they were
willing to do was illegal, but yet it is OK for you to do it. Isn't that=
called something
like Special Pleading ??

I'm not sure what "Special Pleading is" so I can't say. But yes, I was the
first :) and I hope you didn't get upset. I just wanted to protect something
that I feel should rake in all the money it deserves.

Let me first say that I am not above the law. I have been following this thread
to see others' views which have been very well-expressed.

My defense in posting the piece of "Duel of The Fates" (DoTF), if it may be
called so, is this:

1) My intent was not to distribute any track from the DoTF CD single. I did not
post the entire track. This was specifically done so that if anyone wanted a
real copy, they'd have to buy/obtain one of their own.

2) The CD is a promotional copy specifically sent so that I would play it hence
giving it the promotion that all involved wanted. TV and radio stations often
practice this in broadcasting. They'll broadcast a piece of the
music/movieclip/whatever during interviews, newsstories, etc. to promote it but
not in its entirety of course.

3) To compare the posted DoTF track to a Lego minifig torso, I didn't post a
complete minifig torso so that y'all could swipe the pattern and make your own.
If you did think that, then I should probably apologize for not making my
intentions behind posting this more clearly. (I am sorry!) But I'm not
accepting culpability for what you thought.

This is not much different than scanning official Lego pictures so that we
could see Darth Vader and R2D2, even if it's for "reference purposes only". It
was just to show you "what it looked like", as in many lego photos found on the
web so that viewers can appreciate the "minifigure" that it is. Certainly
someone could copy it or anything else and do what they wanted, but at their
own risk.

4) In addition to the DoTF CD single, I also have received a promotional copy
of the whole TPM soundtrack, but notice I didn't offer any other tracks from
the soundtrack or pieces of them.

I have worked in radio for over sixteen years now, so I know a little about
this. I welcome relevant questions/comments/criticisms regarding this
music issue. But just so you know, I don't read off-topic.debate much, so if
you want me to debate, try and leave the subject line intact. :)  Also, other
than music, I don't debate copyright law. It's too gooey.

when replying, it's not okay to distribute spamcake in its entirety either.
