Its the other way around, with Rh- mothers and Rh+ babies, since the Rh factor
is a dominant trait, and an Rh+ mother cannot conceive an Rh- baby (barring
extreme and unlikely genetic mutation, that is).

At present, only a tiny handful of States and D.C. still require a blood test,
and according to this page that I just found, most are only concerned about
syphillis, and the remainder are only concerned about ruebella. No States
require premarital Rh tests, and apparently none ever have. Its still a good
idea to get checked for Rh factor (unless you know for a fact that one or both
members are 100% sterile), as they have developed techniques that allow the baby
to be safely carried to term in this sort of situation (up to and including
inter-uterine transfusions and forced premature delivery), and as stressful a
process as that must be, it has to be infinitely preferable to going through a
pre-natal death. Regardless, I was more referring to the fact that in the past
you could be denied a marriage license for reasons that are no longer considered
to be valid, such as the days when interracial marriage was illegal in much of
the US, for fear of polluting the gene pool or some other silliness.
