Actually, since there are no liabilities assumed or assurances given by Dan, and no licenses from any government sought, there is no need for government involvement. The problem is getting someone to buy from you in the first place, sometimes it will take a while before things start rolling. X.com no longer allows funding your account with a credit card, so it will not easily replace Paypal. Payplace is pretty nice, but the only way to get your money out is to credit your credit card.
