Hi guys and gals, I just wondered your thoughts on this situation.

I recently sold an item on brickbay that I described as MISB. I bought the set
off of ebay or yahoo a couple months back. It was described the same way. I
sent the set to the buyer and he claims that is has been opened...now I didn't
examine it with a magnifying glass or anything, but to me it was still sealed.
The peices are all accounted for and still sealed in their baggies.

Has anybody had this problem before? What should I do? I'm just like most of
you guys and doing this for fun, so I can't exactly pay him to ship it back to
me! I offered to buy the set back for its full value of $50, but not to
reimburse for shipping. Is this fair? I've also offered him a couple other sets
at 1/2 off prices on my shop...am I being unfair, or is it the buyers
responsibility to be aware of exactly what he or she is buying?

Thank
John

(...) If you can see the pieces in their still sealed baggies, then I guess the box must have been opened. So MISB is close, but not totally accurate. At this point I would try to make up for an honest mistake, even if I lost money on the deal. (23 years ago, 17-Apr-01, to lugnet.market.buy-sell-trade)

John, You have to understand that when listing a set in MISB you have the power to command and expect top dollar for the set in question which makes it a factor worth looking into. The last thing you want is for a serious collector to buy your set (...) (23 years ago, 17-Apr-01, to lugnet.market.buy-sell-trade)

Just my two cents here... I have just completed a trade for sets from John. I plan to visit Brickbay and post very positive feedback. My package was received, but sets were slightly buckled by the POST OFFICE. But it matter not since I tore into (...) (23 years ago, 17-Apr-01, to lugnet.market.buy-sell-trade)

(...) Never had it happen to me, but IMHO the best you can do is take it back, give the guy a refund and pay for shipping. I know it's a bitch, you loose some (perhaps a lot) of $$$ but nobody can afterwards say anything that might work against you. (...) (23 years ago, 17-Apr-01, to lugnet.market.buy-sell-trade)

(...) Hi John! I think you were very fair in offering to buy the set back. In fact, that's what I would do too. You may not get the profit that you made from the set in the first place but someone else WILL buy this set regardless if the box is open (...) (...) So far in this thread I didn't see anyone mention what MISB stands for. Is this a case of just mistaking an acronym?. I think it bears mentioning that it is Mint In Sealed Box. For my two cents there is no misunderstanding what sealed box (...) (23 years ago, 17-Apr-01, to lugnet.market.buy-sell-trade)

Hi John, Thanks for the Vision Command, wife didn't kill me yet =) About the opened set, did he say "the seal has been broken" or " it looks like this has been opened". I've gotten older sets that were MISB, and the factory seal on the box seemes to (...) (23 years ago, 18-Apr-01, to lugnet.market.buy-sell-trade)
