Actually, the Indy Racing League is owned by Tony George, who also owns the
Indianapolis Motor Speedway (where the 500 is run). "Indy" and "Indycar" are
trademarks of the IMS. Prior to 1995, "Indycar" was used with permission by
Championship Auto Racing Teams (CART), who raced at Indy as one of their
races. When the leagues split in 1995, CART phased out use of the term;
there may have been a court case involved. But, you're right: "Indy" is a
trademark, which IMS and IRL need to protect.

Now, for the on-topic Lego stuff: I don't see why the set needs to be phased
out; the decals on the car say "F1" on them, so it's pretty obvious that the
set was originally a Formula 1 car. (The raised nose with the drop-down
front wing also identify the car as F1.) Since F1 is coming to the US this
year, awareness of F1 will probably increase somewhat; TLG could just rebox
the set under a different name, though they might not want the set to
compete with "Silver Champion." I, for one, am hoping that a new, but
same-scale car is produced every few years so that I can build up a grid.
Indy Storm looks Jordan-esque, and Silver Champion is a pretty obvious
McLaren. A red car next would be very nice.

Since the Indy Racing League (IRL) had to go to court to prove that they • (not
the Indianapolis Motor Sports Park (home of the Indianapolis 500) had
legitimate claim to the name "Indy", they have to do all they can to • protect
their copyright (and it is a TRADEMARKED copyright of the Indy Racing • League).
So, if TLG puts the name "Indy" on a set, they are violating a trademarked
copyright in the US, and the Copyright and Trademark office takes a very • dim
view of this.

Why should they need to recall it?  Surely all that matters is that they
change the name of the product on future packaging and in next year's
catalogue?

I was told by a Lego person that 8445 Indy Storm has been recalled by • Lego
due
to a trademark violation of Indy.  This affects the US or Americas • distribution
only as Europe has a different product name.  The product does not • appear
in
the Lego.com catalog or the latest S@H catalog.
