  Can they do like this?

Today I received an e-mail from 'MAERSKINFO' in Copenhagen. <quote> Referring to your web page on (URL) neither warrant nor represent that you use our name on your homepage. Please remove any use of the MAERSK name on your web site and confirm that (...) (25 years ago, 26-Jan-00, to lugnet.publish, lugnet.general)

Re: Can they do like this?

Anders, (...) Well, if they hold the copyright (I am no lawyer, so please do not confuse this with official legal council!), I am sure it is international, they can protect it. Even though I really liked the pov-ray version, I think they think of it (...) (25 years ago, 26-Jan-00, to lugnet.publish, lugnet.general)

Re: Can they do like this?

(...) Well my guess is they don't want to be represented in a negative fashion where it might be viewed that you have something against the company. My guess is that if you had just put the boad floating in the water without a list or the explosion (...) (25 years ago, 26-Jan-00, to lugnet.publish, lugnet.general)

Re: Can they do like this?

(...) I'm not a lawyer, but what you have there is a work of art, and I think it is therefore protected from that sort of corporate nonsense. By the way, it's very nice! --Colin __ __ __ __ __ __ | |_| |_| |_| | | |_| | | | Brick Engineer | | | (...) (25 years ago, 26-Jan-00, to lugnet.publish, lugnet.general)

Re: Can they do like this?

Consult a local Intellectual Property Lawyer. Laws vary from place to place and you need professional advice and counsel. However, my opinions: I'm assuming they hold a valid trademark for that name in your country. Even so, unless it's sufficiently (...) (25 years ago, 26-Jan-00, to lugnet.publish, lugnet.general)

Re: Can they do like this?

Kevin, Maersk is the largest shipping company around, I believe. It is family owned, based in Denmark, and the only Dutch company bigger than Lego. This work of art should be protected by the same laws that would allow political satire of public (...) (25 years ago, 26-Jan-00, to lugnet.publish, lugnet.general)

Re: Can they do like this?

(...) Maersk is kind of tangled, nationality wise(1)... but TLG is Danish, not dutch. Still, Maersk is bigger than TLG and is based in Denmark, so I'm just nitpicking, not disagreeing. Quoting: The A.P. Moller Group, whose headquarters are at (...) (25 years ago, 26-Jan-00, to lugnet.publish, lugnet.general)

Kevin Loch skrev i meddelandet ... (...) in (...) Well, I think I can understand them, do a web search on 'Regina Maersk', and you'll find that it's the worlds biggest tanker (not at all like the model), and among the first ten hits (at the search (...)   Re: Can they do like this?

Eric, Did you have to do anything about the AT-AT, etc. built for Mindfest? Or was this not an issue? EC (25 years ago, 27-Jan-00, to lugnet.publish, lugnet.general)

Re: Can they do like this?

A couple of people have already given some good legal advice (like Kevin Loch). But when it comes down to it, they're not going to risk huge court expense and bad pr by actually doing anything about it. I would give them a nice friendly "screw you" (...)   Re: Can they do like this?

The area of trademark law is a bit fluffy (short on hard and fast rules). For an interesting trademark law case that discusses the law of trademarks as it relates to internet domain names, check out the decision in Hasbro, Inc. v. Clue Computing at: (...)   Re: Can they do like this?

Wow! Thanks for that pointer. That was interesting indeed. So in your considered opinion, when Lego requests that Lego not appear in domain names of fannish sites, are they harboring a valid concern? Similarity is higher than in the Hasbro case, but (...) (25 years ago, 28-Jan-00, to lugnet.publish, lugnet.general)

Re: Can they do like this?

[ FUT lugnet.publisch ] Anders: [...] Det er en tom trussel. Din side er et kunstværk og det eneste de muligvis har ret til at kræve er at du diskret skriver at "Maersk" er et registreret varemærke der tilhører A.P. Møller-koncernen (hvis det ellers (...) Maybe you should include a scan of the original book picture on your webpage to prove that you were not trying to show the sinking of (...)   Re: Can they do like this?

(...) From what I read there, TLC's claims for LEGO are very different, for at least two reasons: 1. LEGO is not a common word 2. Fan web sites are about the same product (25 years ago, 28-Jan-00, to lugnet.publish, lugnet.general)

Re: Can they do like this?

(...) I guess the answer depends upon the domain name (I waffle just like a real lawyer :)). Clearly www.legos.com and www.lego.org would both be a problem using the "likelihood of confusion" test. Both of those domain names could draw internet (...) (25 years ago, 1-Feb-00, to lugnet.publish, lugnet.general)

Re: Can they do like this?

(...) Speaking of online casions the easy to eliminate them is for the us government to just ban ads for online casions. The casinos rely on ads for their customers and most of the large advertisment providers with the big exposure that the casinos (...) (25 years ago, 2-Feb-00, to lugnet.publish, lugnet.general)
