I must say that that isn't a nice accusation to say.  It would be like having
sticker scans posted, and have somebody else with stickers criticizing how
you obtained them...

Well, scans of stickers are technically a copyright infringement. TLC
happens to be pretty lenient about publishing scans of their
instructions and whatnot, but they have never expressly licensed anyone
to do so (well, perhaps they have now specifically licensed Kevin to do
so).

I'm not sure what the court has to say about accessing pictures which
are on a public web server, but are not linked to a "published" web
page. Such snooping could fall into the realm of laws covering hacking.

On the other hand,

TLC really needs to get their web folks some education. There is almost
no reason whatsoever to pre-publish stuff on a public web server. Any
large web server should be duplicated by a non-public server, with new
updates put up on the private one first and tested. Only when testing is
complete should the pages then be copied onto the public server.

The book publishing equivalent to this would be an author putting the
draft of their new book on the shelf at Barnes and Noble so the editor
could get a copy to review...

And one final point:

COPYING the pictures from LEGO's web site and posting them to BrickShelf
IS a copyright violation, and probably one TLC would not consider "fair
use" (and that the courts would agree with), so in the end, Tim's
accusation is probably absolutely correct. Kevin probably should remove
the pictures.

Just because someone else posted pictures first, doesn't mean (...) (22 years ago, 19-Jun-02, to lugnet.starwars)
