In cases of
missing parts from sealed sets, I think they should.  In cases of missing
parts from tampered sets, then I think it's the store's responsibility.  But
in my case, it was a specifically discounted buyer beware type thing,

Consumer Affairs will ask you if it was clearanced.  Just be frank with
them,
and if they want to charge you then you can decide if it is worth it.
Customer satisfaction is usually more important to them than assigning
blame for the missing pieces.

Pretty often I buy clearanced items that *have* been opened and are
*obviously* missing pieces, and then I *don't* talk to Consumer Affairs,
because I can see that there are enough pieces in the box to make it
worth buying anyway.  If it is too disgusting inside I'll return it
to the store, though.  I'll leave off before I start a thread about
the most disgusting thing you've found in an opened Lego box. :-)

(...) Thanx Mark. I caught a thread along this line in the Star Wars group, where somebody was missing a Boba Fett from an opened Slave I set. The issue came up of whether LEGO should be replacing the parts free of charge. In cases of missing parts (...) (25 years ago, 29-Jan-00, to lugnet.market.shopping)
