I never did nor ever planned to make money off any of my movies. They were there to simply add another dimention to my website and online story.

Did you email them to ask permission prior to using their work? Perhaps you could have simply gotten their o.k. to use a small snippet for non-profit purposes.

   Like I had said, I thought I had changed it enough to where the music wasn’t theres anymore, thus I didn’t need any credit. The other three movies do have credits at the end, as I did not edit the music found therein.

Obviously you didn’t change it enough that it was completely unrecognizable. But again, perhaps just contacting them in advance would have prevented this incident.

   Right or wrong, the fact is they never viewed the movie to begin with, so credits or not credits it wouldn’t matter.

But you did take their music. You have said so yourself.

   The email stated that they were told that the movies on my website contained music from their game. Only one movie of the four contained any part of their music. Had they visited my website they may have known this. Had they visited they wouldn’t have said ‘they were told.’

Perhaps they were told, and then they visited. I would find it unlikely that they took the word of a 3rd party without doing a bit of checking for themselves.

   What’s worse is that the parts of the music I used from their game was nothing more than a drum cadence. A repeating, 3 or 4 stanza long series of drum beats. No melody, no harmony, everything of the sort cut out. Just the drums. All of this over constantly repeating percussion.

Again, it was obviously still close enough that someone recognized it.

   At least they were kind enough to request that I remove the music from the movie, allowing me to return the movie to the website once I found another suitable piece. Not that they could stop me from putting the movie back online after changing the music anyway, but still.

Then why not just do that? Can’t you find some public domain drum track? Or find a friend with a synth to ‘drum’ one up for you? :)

Copyright is a serious issue. While you weren’t violating copyright with the intent to make money look at the situation from another perspective. What if someone had come along and copied one or more of your movies? They changed the title, edited it a bit and then included them on a DVD that was then sold for profit.... only you weren’t informed and didn’t get any of the profit. Would you be so willing to say, “but they changed it, so it’s o.k. that they didn’t ask permission.“?

I realize you weren’t trying to make money with your movie right now. But what if you decided to do that later? The company had every right to protect what is theirs. Just as you have the right to protect any of your original work.
