Seems pretty clear that he's only actually copyrighting the SetDB software,
which IMO looks like a pretty cool tool, and that 'to get you started, and save
you weeks of download time' he's including scans of all the instructions in his
collection. He may not necessarily have the legal right to distribute those
instructions, free or otherwise, but they are all available from brickshelf
anyway, and any potential SetDB user is free to download them and use them in
the database, so all he's really doing is saving the buyer the hassle of doing
it themselves.
I for one would like to see a web version of it. Browsing instructions through
Brickshelf is soooo clunky unless you know the exact set number you're after.
