Privateer would require a letter of marque and a ship.  A ship's captain • would
require that he was the captain of a ship.  Neither would define him as a
treasure hunter.
I know!  If he got his doctorate, he could call himself an archeaologist!
Should we switch this to lugnet.adventurers?  :-)

Okay smart aleck! :O)

  Well here's the deal.  He does have a ship and he does have a crew but no
letter of marque. (That's an official document, right?)  He's replaced the old
skull and crossbones with a smiley face and a bow tie, though it's close
enough to the Jolly Roger to still intimidate folks from a distance)  I know
that a bow tie is out of it's time zone, but it's more of a comic story for
kids.

Then he be a Cap'n.  Wif'ou' Letters o' Marque an' Reprisal from offishals uv
da King, he ain't a Privateer.  'Taint 'gainst the law ta be seekin' treasure,
but thar might be prior claimants or ye may only claim a portion (assumin' ye
report it, o' carse).  Be a tricky point o' law, I be supposin'.  A reformed
pyrate, in truth, be whut scholars call an oxymoron.  Or tha guv'nor o'
Jamaica.  :-)
