eBay has a "Powersellers" program for sellers who do more than $2000
worth of business a month on there. Powersellers are required to give a
"Guarantee of Satisfaction". Here's what the Powersellers FAQ has to
say:

Q. What do you mean by "satisfaction guarantee"? As a PowerSeller, what >are my obligations according to this guarantee?
A. Offering a satisfaction guarantee requires a PowerSeller to uphold a >high level of professionalism. This includes prompt
responses to successful high bidders (within 3 business days) and the >assurance that merchandise is accurately represented in
an item description. It is up to the sellers and buyers to resolve >details such as refunds or exchanges.

"Accurately Represented" is the key phrase here: if the seller is a
Powerseller we might be able to complain either to them or to eBay that
an item was not accurately represented if it's listed as "Hard to Find"
when it's not (like the person currently listing 4561's).

Well, I just did it - emailed one of the McDonalds Drive Thru sellers, quoting that paragraph, and pointing out that their listing (which states "This kit is not available in stores and was produced in extremely limited numbers.") might violate it. It would be funny if the seller came back and told you that the item was listed in the LEGO S@H catalog with a big "Hard to Find" graphic and so he was just passing that info along to his bidders! -- Scott Smallbeck scotts@contactics.com (URL) (...)
