I don't think there's any question about intent on eBay's part. They
don't want members who cannot enter into enforceable contracts. But,
just as with a sign that says no trespassing, which shows intent that no
one enter the land without permission, intent and perfection of outcome
are two different things.

It's difficult to prevent someone who is determined from joining and has
access to a purloined credit card and knowledge of an adult's personal
information such as address birthday and SSN from gaining access, no
matter what that person's age may be.

eBay can't be singled out for fault as it's an endemic problem. But eBay
COULD do more to help out sellers when this happens.

I for one feel that parents should have some responsibility for their
children and I would think eBay ought to go after the parents for the
auction listing fees. Systematically.
