The way I've heard it is that they don't produce any weapons developed in the 20th century or later, and that the only reason why we have the Sopwith/Red Baron pair is because LEGO Direct operates under slightly different rules when developing (...) (...) I think it's more an issue that they don't want to produce toys that look like they can be used to emulate the modern warfare that they see on the news and such.
