The ship has to have seats for three (e.g. pilot and two passengers), but
according to the rules, you can carry ballast for the two passengers and still
win the prize. This rule is in place to encourage the development of a vehicle
that has the ability to carry passengers, but they didn't want to write the
rules to encourage the unnecessary risking of lives on early test flights.

This thing is all over the sci.space newsgroups on Usenet (has been ever since
his design went public). He didn't give the required 30 day notification to the
X-Prize Committee, so this next flight won't count towards the prize. It is
expected that if this flight is successful, he will be giving the 30 day notice
before making another attempt (presumably following all the rules).
The rules also state that you have to make two flights, within a week of each
other, in order to win the prize. Expendable missiles with people on top need
not apply.
