I'm pretty sure the driver is loaded, this is the output from lsmod:

and I created /dev/usb/lego0 myself as a character devince with major number 180
minor number 160.  I'm not running udev.

Ok, the driver is loaded and major number 180 minor number 160 is correct.
Do you see something like this:

drivers/usb/misc/legousbtower.c: LEGO USB Tower #0 now attached to major 180 minor 160
drivers/usb/misc/legousbtower.c: LEGO USB Tower firmware version is 1.0 build 134
usbcore: registered new driver legousbtower
drivers/usb/misc/legousbtower.c: LEGO USB Tower Driver v0.96
