Shouldn't the airspace above your property be yours, subject to deeded
covenants?
Obviously if we were to switch over to Liberatopia, air rights would
have to be negotiated with everyone. I would expect a few airports to be
forced to close because the neighbors who have never wanted the airport
next to them might chose to refuse to grant those air rights as the
easiest method of closing the airport. I would also expect that for the
most part, anyone whose property was undeveloped at the time the airport
was built, and someone else owned the land at the time, would have not
very much standing to refuse to grant the air rights, but I'd have to
see a pretty solid justification before I totally agreed that they would
lose their rights.
In converting to Liberatopia, there would almost have to be some general
agreement that there is a statute of limitations on prior property
rights. I think it would be very difficult to resolve the issue of the
original Native American's property rights for much (if not all) of the
US. I do think we owe the Native Americans who still live on
reservations more than they currently have, but not all that they might
demand.
