Maybe I'm reading this wrong, but I'm having trouble getting my head into
the space you're describing. Let me try a different example to see if I
understand your position:
Suppose someone is in the process of stabbing you in the chest with the
intent to end your life, and you have the means to stop him, but only by
killing him, and so you kill him. Would you still label him innocent and
yourself guilty, and therefore deserving of punishment? What if he kills you
and is never caught; is he "innocent?"
If so, I must confess I would have difficulty living up the strictures of
such a society...
