Federal court throws out Lego's trademark case against Mega Bloks Inc.

MONTREAL - A court has dismissed a trademark case involving Lego Canada Inc.,
in which the producer of the popular building-block toys alleged that a
Montreal-based toy company was stealing its look.

Lego, and its trademark owner, Kirkbi AG Corp., alleged that Mega Bloks Inc.
was trying to pass off its toy construction blocks as a Lego product. Lego
argued it has the exclusive rights to the look of the knobs on its standard
toy
bricks.

Lego has lost a number of similar court against Mega Bloks in other countries.

In the United States, the largest market for Mega Bloks products, the courts
have rejected Lego's request to be awarded exclusive industrial and commercial
property rights to the block design.

Lego also lost a similar case to Mega Bloks in France.

Lego has also sued its rival in Portugal, Spain, Greece, Belgium, Italy and
the
Philippines. No final verdicts have been handed down in those countries, but
Mega Bloks has won a number of preliminary rulings.

For its part, Mega Bloks has filed suit against Lego in Germany, Switzerland
and the European Union patent office, challenging the toy-maker's trademark of
certain brands of blocks.
