Maybe this belongs in market.theory, but is Tuesday Morning breaking • any
kind of law by advertising sale prices at 50% off that are completely
fictional? For instance, I have only ever seen the 2555 Belville set • at
Shell stations for about $10. Yet TM claims that they sold once for • $24.99.
I know that KB Toys, FAO Schwartz and many others routinely mark up • LEGO
well above retail, but not Shell promotional sets, surely.

I know LEGO often provides Suggested Retail Prices that are well above • what
normal retail channels sell at, including Shop at Home.  For example,
Mindstorms RIS 1.5 SRP is $237.99.

Doesn't the US have some laws to cover what can be advertised as a sale
in terms of price, etc?

In the UK a product must have been on sale by that store at the original
price for 28 days or more before they are allowed to use the original
price as a comparison.
However, this is usually easily got round by chain stores as it only has
to be in one of their stores.
So they put the product on sale at a high price in one store for 28
days.
Then flood the rest of the stores with the sale price thereafter.

They can also just put something up as a 'Special purchase' of course,
but cannot reference a previous price (hence claiming a saving) unless
it meets that 28 day rule.

(...) Don't know about the legal issue. Tuesday Morning typically isn't selling 'On Sale', they are a clearance store. What they do is list 2 prices, their price and retail. The retail number lately is well above the normal retail price. -Rob. (23 years ago, 18-Apr-02, to lugnet.market.theory)
