Well, their TOS specifically addresses mis-categorization. In fact, I've been
tempted to invoke this, it specifically addresses, and disallows things like
"Mega Bloks set, just like LEGO". By a strict reading of their TOS in fact, the
non-LEGO construction toys do not belong in the LEGO category at all (or TLC
needs to tell eBay that the category can not be named LEGO if it is indeed
supposed to be for all similar construction toys). Of course, TLC should really
be the ones contacting eBay. I think that what is going is activity which if it
isn't addressed by TLC, will weaken TLC's ownership of the LEGO trademark (but
IANAL so who knows).
