While I was out Friday night, my dogs decided to knock the castle off and make a meal of the case as well as several pieces of the castle itself. Thus, I will not be sending the castle to you. I have refunded your payment via PayPal. Please accept my apologies.

Thanks, XXX

XXX:

Would you be so kind as to email me a photograph of the damaged set? Absent some kind of documentation I think I shall have to leave you negative feedback and document our transaction for others.

That was a good price for that set and I REALLY wanted it. A deal is a deal.

Thanks.

Well, the case was chewed up pretty badly and covered in blood from my dogs’ mouths and the instructions were shredded all over my office, so I threw those out. There are several small pieces that are just plain missing... I would assume that they ended up inside my dogs. I’d be more than happy to take a picture of the pile of pieces and send it to you if you would like.

Yes, that would be useful for me. I’d like to see something that proves your story to me. Absent that, I have to assume that you are simply backing out of the deal. I am sorry if my request seems ghoulish. I think if you were me you would also require some proof that the set was damaged. It’s not fair to me that you should expect otherwise.

That set can go for as little as $3-4 (at least once before) or for as much as $100+, it just depends on the day. And what can I say -- “my dog ate it” is a suspiciously common enough excuse that I have to wonder about the veracity of your story.

The reality is that you are breaking our auction contract -- no matter what -- you owe me for that. I am willing to ignore that fact if you can prove to me that you are telling the truth. In other words, I would easily be within my rights as buyer to give you negative feedback already, but I won’t add insult to injury if you can prove that you are actually being honest with me. Giving you negative feedback for an accident of life (i.e. “my dog ate it”), would be unfair of me -- not from an eBay technical standpoint, but from my own personal viewpooint as an empathetic human being. As it stands I intend to give you negative feedback, I am giving you a way out if you can prove your story to me.

You had a fiduciary responsibility for property already belonging to me because of our eBay auction contract. You had already received the money for the set and shipping and handling besides. Then you let my stuff get damaged in the meanwhile. Now you have refunded the money (and for which I thank you) and claimed a somewhat suspicious story as your reason. If the story is true I am deeply sorry for your troubles. But for the sake of myself and other eBay buyers I must ask that you prove your story or leave you negative feedback. I can just give you negative feedback now and we can forget about it if you like.

snip (...) Well it sounds like you are being quite fair to me. After all his story does sound a little fishy and I can't help but wonder if it was because the auction didn't go as high as he had hoped. -Mike Petrucelli (21 years ago, 12-Aug-03, to lugnet.off-topic.clone-brands, FTX)

As much as I hate to say it, I'd just forget about it and move on. I understand its the whole principle of the idea, but in the final analysis, evilBay will do nothing about it. I'd go ahead and put a negative feedback in tho. (...) (21 years ago, 12-Aug-03, to lugnet.off-topic.clone-brands, FTX)

(...) It does appear as though the seller is trying to get out of letting you have a set that went cheap because he carelessly misspelled 'castle' in the listing. Of course, it is possible that his dogs could have picked this time to chew up a (...) (21 years ago, 12-Aug-03, to lugnet.off-topic.clone-brands, FTX)
