In my opinion this is a direct copy....

So you guys that are saying this is no big deal are basically saying all
MOCs are fair game?  This makes me want to go through all of your galleries
and pick one of your creations, copy it as best I can, and sell it.  No big
deal right?

The selling of work created by others is wrong.

Yes.

Having said that...
I have copied many creations by other people.  That is where I get
90% of my ideas.  Right now I have 2 buildings on my Train/Town
layout that are almost exact copies of buildings done by MichLug
members and used in a recent public show. I plan to use them for a
public show, too, next month.  I have not asked permission and don't
think I have to.  When people ask me about what I have built, I
almost always reply that I stole the ideas from other builders.

I think as long as you don't claim they are your designs, that's
fine.  Permission shouldn't be necessary, but it would be nice as a
kind gesture to the person who designed the model to let them know.

The pictures on Brickshelf are in the public domain.  I think it is
fine to copy whatever you want for non-commercial purposes.  I am a
massive picture pirate and have collected many thousands of pictures
from Brickshelf and other websites over the years.  When I am
looking for ideas, I browse the archives I have saved and make a
color print out of what I want to copy.  Then I set to work making
my own version.

They are most certainly *NOT* in the public domain!  They are
copyright by the person who created them, like any other original
creative work.  And technically, the models too are copyright.
However when stuff is posted on the web, one could probably argue that
there is implicit permission being granted to copy them.

Just because something can be freely copied doesn't mean it isn't
copyrighted.  It just means that the copyright owner is permitting you
to copy their work.  Public domain is a very different thing.  But,
IANAL.

There is an old adage that goes
"Imitation is the highest form of flattery"
And this is an idea that I subscribe to in regards to Lego.

Yes, this is true.  A member of our club has copied a couple of ideas
of mine, and it made me feel really good.  But there's a difference
between that and profiting from someone else's work, like this ebay
seller is apparently doing.

Most people who post MOC pictures online are proud of what they have
built and what to show it off.  To expect that some of these ideas
would not be copied by someone else is ridiculous.  For myself, I do
not consider myself an idea man, but I can implement what others
have come up with.  So I get good sucess by copying and often
improving upon what others have already tried.

Yeah, that's fine - but give credit where credit is due.  Don't claim
it's your idea.  If you post about it, it would be nice to say that
you borrowed the idea from so-and-so's model.

If this bothers some people, I say "Too Bad."  In the sprit of Lego
toys, I think copying others ideas is perfectly fine.  However,
doing it as a money-making venture is very wrong and copying
someone's work in order to sell the results is bad news.

I think I agree with this.
