Call Consumer Affairs, I don't have the number, or try to return it. It
is up to you, but be warned, retailers are picking up on the scams
people have been doing. I would show the person the minifig, and say the
backpack and helmet, it is useless.

P.S. We have been seeing this a lot, I wonder if both of mine have
everything, they are both sealed?
