My understanding is that the owner of brickbay.com agreed out of court
to change the name. It may well be that if it had gone to court he
would have won, but as you pointed out earlier lawsuits are expensive
and it's unlikely IMHO that he would have been able to collect any
damages to pay for his legal fees, even if he did defend brickbay.com
successfully.
