Some of the new 2004 sets were released in December of 2003 (Mos Eisley Cantina,
for example), and they did have the new grays and brown. Even though these new
sets were released in the very end of 2003, they're still considered to be 2004
sets. (They have "2004" on the box.)

Yes, you're right; sets that originated before 2004 but are still made in 2004
will have the new shades of colors. I read a post (I think it was the Q&A from
BrickFest PDX) in which Jake McKee was quoted as saying that Legend sets that
continue to be produced will have the new grays. Personally, I really really
hope that Shop @ Home lets people know when this color thing changes phases. If
I bought a Black Falcons Fortress re-release, and it was the new gray, I
wouldn't be very happy.
